26 year-old Terrell Grinnell, appeared before Magistrate Judge Scott Bogue at the Pennington County Courthouse on Wednesday for his initial hearing on a third-degree rape charge. The charge, a Class 2 felony in South Dakota, carries a maximum penalty of 25 years in prison and a $50,000 fine.
Prosecutors allege Grinnell raped a 33-year-old woman who was mentally or physically incapacitated. Citing the seriousness of the case, the state requested bond remain at $50,000.
Defense attorney Ellery Grey argued for a reduction, noting Grinnell had retained legal counsel and planned to stay with his mother to comply with court orders, including a no-contact provision with the victim.
Judge Bogue ultimately lowered the bond to $25,000 cash. Grinnell’s arraignment is scheduled for October 6 at 2:15 p.m.
