The South Dakota Supreme Court is holding its October term beginning today at the Knudson School of Law in Vermillion, hearing oral arguments on eight cases over two days.
The opening case on the docket is Morse v. State, where residents of Hideaway Hills in Black Hawk are appealing a circuit court ruling after a massive sinkhole in 2020 revealed their neighborhood was built atop an old gypsum mine. The plaintiffs argue the state failed to properly reclaim the land, leading to structural damage. The appeal challenges sovereign immunity and seeks to establish an inverse condemnation claim.
