A California man made his first court appearance Tuesday, accused in a crash that killed a 25-year-old Kyle resident.
Nicholas Foltz, 37, is charged with vehicular homicide and driving under the influence.
According to the South Dakota Highway Patrol, Foltz was driving a Mercedes Benz on Bombing Range Road in Scenic early Friday morning when the vehicle left the roadway and rolled into a ditch. Thomas John Barlese, a front-seat passenger, was partially ejected and pronounced dead at the scene.
If convicted of vehicular homicide, Foltz faces up to 15 years in prison. He remains in the Pennington County Jail on $100,000 bond.
Prosecutors noted Foltz was recently arrested for battery in California.
