South Dakota Attorney General Marty Jackley has ordered Mayday Health to immediately stop advertising abortion pills in the state, warning that legal action may follow if the company fails to comply.
Abortion is banned in South Dakota except under limited circumstances, and state law prohibits administering or procuring drugs to induce abortion. Jackley said Mayday Health’s ads mislead consumers by suggesting abortion pills are legal, while also urging women to avoid medical care and keep their abortions secret.
At Gov. Larry Rhoden’s request, Jackley launched an investigation, concluding the company’s practices violate the South Dakota Deceptive Practices and Consumer Protection Act. Mayday Health could face felony charges or civil penalties of up to $5,000 per violation.
Gov. Rhoden praised Jackley’s swift response, stating: “South Dakota moms and babies deserve to be protected from deceptive advertising.”
