Attorney General Marty Jackley announced that the state will receive $102,888.64 from a multistate settlement with Menards over allegations that the company deceptively marketed its merchandise credit check program, commonly known as the “11% Rebate Program.”
Jackley joined nine other Attorneys General in investigating Menards’ practices. Allegations included misleading “11% OFF” advertising that implied an immediate discount, advertised prices that suggested savings at checkout, inadequate disclosure of rebate limitations, and misrepresenting “Rebates International” as a separate company.
Under the settlement, Menards must: Stop advertising rebate‑based store credit as a point‑of‑purchase discount, Clearly disclose all rebate terms and limitations, Explore secure online submission and redemption options for rebates, Disclose that Menards operates as Rebates International, Allow at least one year for consumers to submit rebate claims, Update its online rebate tracker within 48 hours and provide additional claim information, including updates related to returns
South Dakota’s share of the settlement will support the Attorney General’s Consumer Protection Division for education and future investigations.
Participating states included Arizona, Illinois, Iowa, Kansas, Michigan, Minnesota, Nebraska, Ohio, and Wisconsin.
