South Dakota Attorney General Marty Jackley says a state circuit court has ruled that the state’s lawsuit against Mayday Health can move forward, ordering that a trial date be set. The lawsuit alleges the organization engaged in deceptive and unlawful advertising regarding abortion pills.
In December, Jackley issued a cease‑and‑desist letter directing Mayday Health to stop advertising the availability of abortion pills in South Dakota, where the practice is illegal. His office also filed a motion in state court seeking to halt any ads that are untruthful or violate state law.
Mayday Health responded by seeking an emergency temporary restraining order in federal court in New York. A federal judge ruled last week that the case belongs in South Dakota state court, clearing the way for the lawsuit to proceed.
