South Dakota Attorney General Marty Jackley announced the state Supreme Court has upheld a circuit court ruling to commit a juvenile to the Department of Corrections for making a terrorist threat at Edgemont School.
In a Feb. 25 opinion, the Court affirmed the juvenile’s adjudication for making a terrorist threat and agreed that placement with the Department of Corrections was appropriate. Justices did vacate a separate simple assault adjudication.
Jackley said the ruling reinforces that violent threats against schools will be taken seriously.
The case stemmed from threats made toward a school counselor and others. After an adjudicatory hearing, the circuit court found the juvenile delinquent and ordered DOC commitment. The Supreme Court concluded the lower court did not abuse its discretion.
