PIEDMONT, S.D. — Fourth Circuit Court Judge Michelle Comer has dismissed a lawsuit challenging the legality of a voluntary annexation approved by the City of Piedmont, upholding the city’s decision to annex approximately 130 acres of land.
The lawsuit was filed by P5, LLC, a company owned by the Policky family, following the city’s approval of the annexation in February.
The annexation petition, submitted in January, received support from seven of the eight property owners within the affected area. City officials approved the request as a voluntary annexation, prompting the legal challenge.
In dismissing the case, Judge Comer affirmed the city’s action in approving the petition, clearing the way for the annexation to move forward.
