SOUTH DAKOTA – South Dakota lawmakers could soon take up legislation regulating the use of automatic license plate reader cameras, commonly known as ALPRs or Flock cameras.
Attorney General Marty Jackley says he’s drafting a proposal that would establish safeguards for how the technology is used, including potential rules on data access, retention, and public transparency.
The cameras are used by some law enforcement agencies to identify vehicles and assist in investigations involving stolen vehicles, violent crimes, and missing persons cases. Supporters say the technology has helped officers quickly locate suspects and recover victims.
However, critics have raised concerns about privacy and the sharing of vehicle data through national networks, arguing the systems can track law-abiding citizens without suspicion of a crime.
The debate has prompted some communities to reconsider the technology. Aberdeen recently dropped plans to discuss installing the cameras, while Codington County has temporarily removed its Flock cameras following vandalism incidents.
Jackley says no known abuses of the technology have occurred in South Dakota, but he believes clear safeguards should be in place before problems arise. Lawmakers are expected to consider the issue during the 2027 legislative session.
