South Dakota Attorney General Marty Jackley has announced the creation of a commission tasked with helping law enforcement agencies across the state establish uniform standards for complying with a landmark U.S. Supreme Court ruling on evidence disclosure.
The ruling, Giglio v. United States, requires prosecutors to disclose to the defense any evidence that could undermine the credibility of government witnesses, including law enforcement officers.
Jackley said the newly formed commission will review the decisions and provide recommendations on how South Dakota agencies can meet both the intent and spirit of the ruling. The recommendations will be shared with state and local law enforcement agencies and prosecutors, who may adopt them at their discretion.
The commission includes representatives from state, county, and local law enforcement and prosecution offices.
Their commission’s work is expected to provide a framework for consistent practices statewide, reinforcing transparency and accountability in South Dakota’s criminal justice system.
