South Dakota Attorney General Marty Jackley released a statement regarding President Trump’s Executive Order directing the reclassification of marijuana to support expanded research into its medical use.
On Thursday Jackley and several other Attorneys General participated in a conference call with the White House to discuss the implementation and implications of the Executive Order. Jackley expressed appreciation for the Administration’s continued communication with state Attorneys General. During the call, officials emphasized that the President’s intent is to enable additional research into the medical value of marijuana through its rescheduling.
It is important to note that moving marijuana from a Schedule I to a Schedule III substance under federal law does not legalize marijuana for criminal purposes at the federal level. In addition, federal law still prohibits licensed physicians from prescribing marijuana until it receives approval from the U.S. Food and Drug Administration.
Under South Dakota law, marijuana remains illegal for recreational use. Medical use is allowed only with a valid prescription, a medical cannabis card, and through a licensed medical marijuana facility.
