South Dakota Attorney General Marty Jackley is asking a Hughes County judge to block an abortion‑rights ad campaign by Mayday Health after the group ignored a cease‑and‑desist order. The New York nonprofit placed gas‑pump ads linking to information about abortion pills, which Jackley says falsely imply that elective abortions and abortion pills by mail are legal in South Dakota.
Mayday argues the ads are protected speech and note they only share information, not medication. South Dakota bans nearly all abortions and prohibits telemedicine abortion.
The campaign launched Dec. 8 at 30 planned locations; most stations have since removed the ads, with only two still displaying them. Mayday also plans a digital campaign featuring South Dakotans discussing the state’s abortion ban.
No hearing date has been set. The lawsuit also names Minnesota‑based advertising company AllOver Media.
