South Dakota lawmakers advanced a proposed constitutional amendment that would restrict the use of eminent domain. The measure would bar non‑governmental entities from taking private land when the sole purpose is economic development or boosting tax revenue, without a clear public use. Rep. Spencer Gosch says the amendment protects property owners from losing land for private gain.
But Rep. John Hughes argues the wording is vague and should instead carve out exceptions for essential public utilities.
The proposal passed the House and now moves to the Senate. If approved, it will appear on the November ballot. Last year, lawmakers banned eminent domain for carbon‑capture projects.
