A mistrial has been declared in the assault case involving NDN Collective Founder and CEO Nick Tilsen.
Closing arguments concluded Wednesday afternoon at the Pennington County Courthouse. Tilsen faced charges of aggravated assault and simple assault on a law enforcement officer, as well as a misdemeanor obstruction charge.
The case centered on a June 2022 incident in which Tilsen encountered a Rapid City Police Officer who had stopped a homeless man. Prosecutors alleged that Tilsen drove his pickup toward the officer. Tilsen, however, said he was pulling into a parking space to ensure the man was not being mistreated.
The jury began deliberations Wednesday but later reported that they could not reach a unanimous verdict, resulting in a hung jury and the declaration of a mistrial.
It is not yet known whether prosecutors will pursue a retrial.
