South Dakota lawmakers will return to the Capitol today for the 38th and final day of the 2026 legislative session, where they will consider two gubernatorial vetoes and resolve one remaining funding issue. The House and Senate convene with the House taking up vetoes first.
Gov. Larry Rhoden vetoed HB 1077, which sought a permanent ban on cell‑cultured protein, and HB 1138, which would have required state licensing of non‑medical home care agencies. Overriding a veto requires a two‑thirds vote in each chamber — at least 47 representatives and 24 senators.
Lawmakers have already approved, and the governor has signed, legislation establishing a five‑year statewide moratorium on cell‑cultured protein.
Legislators will also consider SB 121, which funds replacement of the Richmond Lake dam and spillway near Aberdeen. While the bill currently lists a $101 placeholder appropriation, both chambers must approve the final funding amount once bids are reviewed.
Earlier in the day, the Joint Committee on Appropriations will meet to approve letters of intent related to education food assistance programs, Temporary Assistance for Needy Families funding, school finance accountability penalties, and expectations for an $8 million Ellsworth Development Authority roadway appropriation under SB 130.
