South Dakota is joining more than 20 other Republican-led states in urging the U.S. Supreme Court to restrict the remote distribution of the abortion drug mifepristone.
Attorney General Marty Jackley announced Tuesday that South Dakota has signed onto an amicus brief led by Nebraska Attorney General Michael Hilgers. The filing comes as the court considers a case involving a challenge to federal approval of expanded access to the medication.
The states argue that current federal policy allows out-of-state doctors to prescribe and mail mifepristone to patients in other states without following those states’ laws governing abortion drugs.
Earlier this year, South Dakota lawmakers passed a law banning the dispensing, sale and advertisement of chemical abortion drugs. However, officials have acknowledged uncertainty about how parts of the law would be enforced, particularly when medications are shipped into the state.
The case is now before the U.S. Supreme Court following a federal appeals court ruling tied to a challenge from Louisiana.
