South Dakota has joined 16 other states in a lawsuit challenging California’s Plastic Pollution Prevention and Packaging Producer Responsibility Act.
The coalition argues the law places costly and burdensome requirements on manufacturers, distributors, and businesses that use or ship products in plastic packaging. Because companies must comply to sell goods in California, the lawsuit claims the regulations effectively impact businesses nationwide.
Joining South Dakota in the lawsuit are attorneys general from Alabama, Florida, Georgia, Idaho, Indiana, Iowa, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, Texas, Utah, and West Virginia.
The coalition contends California is overstepping its authority, while supporters of the law say it is needed to reduce plastic waste and environmental harm.
