South Dakota’s attorney general says certain childcare and security costs tied directly to campaigning or serving in office can legally be paid for with campaign funds.
Attorney General Marty Jackley issued the formal opinion at the request of State Sen. Liz Larson. In his written response, Jackley noted that state law limits campaign spending to three categories: expenses related to a candidate’s campaign, costs associated with serving as a current or former public official, and donations to other candidates, political committees, or charitable nonprofits.
Jackley concluded that childcare or security expenses may fall within those boundaries if they arise solely because of campaign activities or official duties and would not otherwise exist. He emphasized that such spending must have a clear connection to the campaign or office and cannot provide a personal benefit.
He also noted that lawmakers retain the authority to clarify or revise the statutes if they choose to do so.
