Attorney General Marty Jackley is traveling to New York for a hearing related to a legal dispute over abortion-related advertising. Jackley will argue that a countersuit filed by New York–based Mayday Health should be handled in South Dakota state court rather than in federal court.
In December, Jackley filed a lawsuit against Mayday Health, alleging the group illegally advertised abortion pills at gas stations in South Dakota. In a statement, he said federal courts “must refrain from interfering with ongoing state court proceedings and respect state sovereignty when there exist important state interests.”
The motion hearing is scheduled for today at the Thurgood Marshall United States Courthouse in New York City.
