A Rapid City man has been sentenced to three years in prison for pulling a knife on a Yesway employee during a dispute over stolen burritos.
Tad Montgomery was sentenced Monday in Pennington County Circuit Court after pleading guilty to aggravated assault in a February plea deal. Prosecutors dismissed a related petty theft charge and recommended the three‑year term.
Deputy State’s Attorney Olivia Siglin said the agreement holds Montgomery accountable while noting he has no prior felonies.
Montgomery’s attorney, Bryan Anderson, said he acted out of hunger and asked for a suspended sentence so he could stabilize his life.
Judge Joshua Hendrickson declined, calling Montgomery’s behavior “pretty bad” and saying he could not overlook the seriousness of the assault.
