A proposed constitutional amendment that would clarify that only U.S. citizens are eligible to vote has moved one step closer to the 2026 general election ballot.
As required by state law, Attorney General Marty Jackley has filed a neutral ballot explanation for the Legislature-approved proposal with the South Dakota Secretary of State’s Office. Jackley emphasized that he takes no position on the measure and drafted the explanation solely to provide voters with an objective summary of its purpose, effect, and legal consequences.
The explanation was filed April 28, triggering a 10-day public comment period that runs through May 8, 2026. Comments must address the wording of the explanation, not the merits of the proposal. The final explanation is due to the Secretary of State by May 19.
If approved, the amendment and its explanation will appear on the Nov. 3, 2026, general election ballot.
