PIERRE, S.D. – South Dakotans who purchased certain generic prescription medications over the past decade may be eligible for compensation under a proposed 400 million dollar legal settlement.
South Dakota and 42 other states and territories are seeking court approval of the settlement involving drug manufacturers Sandoz Incorporated and Fougera Pharmaceuticals. The case alleges the companies worked to raise prices and reduce competition in the generic drug market. The companies agreed to the settlement without a final court ruling on the claims.
Anyone who purchased eligible generic prescription drugs between May 2009 and December 2019 may qualify for a payment. Information on eligibility and how to file a claim is available through the settlement administrator.
Under the proposed agreement, South Dakota is expected to receive nearly 390 thousand dollars. The funds will be divided between the state’s Medicaid program and the Attorney General’s Antitrust Fund.
